Welcome to SlenosVibe! These Terms and Conditions govern your access to and use of the SlenosVibe (SVIBE) platform, an NFT-based music ecosystem that allows musicians, producers and licensees to create, purchase and trade digital assets without intermediaries.  

Access and use of the platform implies full and unconditional acceptance of these Terms and Conditions. If you do not agree with any of the points below, please do not use the service.  

1. DEFINITIONS  

  • "Platform": the SlenosVibe website, application and services.  
  • "User": any natural or legal person who uses the platform.  
  • “NFTs”: Non-fungible tokens registered on blockchain, representing rights to musical content.  
  • "SVIBE Token": the native token of the SlenosVibe ecosystem.  
  • "Wallet": the user's digital wallet used for transactions on the blockchain.  
  • "Marketplace": section of the platform where users can buy, sell or trade music NFTs.  

2. SUITABILITY  

To use SlenosVibe, you must:  

  • Be at least 18 years old or the age of majority in your country of residence.  
  • Have a compatible wallet to manage NFTs and SVIBE tokens.  
  • Accept the risk associated with blockchain transactions, including the loss of funds or digital assets.  

3. CREATION AND MANAGEMENT OF NFTs  

  • Ownership and rights: NFTs represent a digital right linked to the music track, but do not automatically confer copyright, which remains the property of the creator.  
  • Authenticity: SlenosVibe does not guarantee the authenticity of NFTs uploaded by users and is not responsible for any copyright infringement.  
  • Licenses: Creators can attach custom licenses to their NFTs, defining rights to use, share or monetize the track.  

4. TRANSACTIONS AND PAYMENTS  

  • Payments: Transactions take place exclusively in supported cryptocurrencies (e.g. SVIBE, USDT, AVAX).  
  • Fees: The platform may apply fees on some transactions to cover development and maintenance costs.  
  • Purpose: All blockchain transactions are irreversible and cannot be reversed once confirmed.  

5. USER RESPONSIBILITIES  

Users undertake to:  

  • Do not upload content that violates the rights of others, including copyrights and trademarks.  
  • Do not use the platform for fraudulent, illegal or money laundering activities.  
  • Protect your credentials and wallet: SlenosVibe cannot recover lost or stolen funds.  

SlenosVibe reserves the right to suspend or ban users who violate these terms.  

6. LIMITATION OF LIABILITY  

  • No Warranties: The Platform is provided "as is", without express or implied warranties.  
  • Blockchain and Volatility: The value of NFTs and tokens can vary significantly. The user accepts the risk of losing economic value.  
  • Maintenance and Outages: SlenosVibe is not responsible for temporary outages or technical issues.  

7. PRIVACY AND USER DATA  

  • Data collected: The platform collects only the minimum data necessary for the operation of the service.  
  • Blockchain and anonymity: Transactions on the blockchain are public and cannot be deleted.  
  • Security: You are responsible for the security of your wallet and associated data.  

8. CHANGES TO THE TERMS  

SlenosVibe reserves the right to update or modify these Terms and Conditions at any time. Users will be informed in case of significant changes.  

9. APPLICABLE LAW AND DISPUTE RESOLUTION  

These Terms are governed by Italian laws. For any dispute arising from or connected to it or in any case relating to its interpretation, execution, validity, effectiveness and resolution:

  • if the Subscriber acts as a consumer, the court of the consumer's place of residence or domicile will be competent pursuant to art. 33 of the Italian Consumer Code;
  • if the Subscriber acts as a professional, the exclusive jurisdiction lies with the Court of Rimini.
